Are All Crimes Violent Crimes in Colorado?

No one wants to be known as a criminal. People especially do not wish to be known as violent criminals. However, the same is not true for violent crimes.

Society differentiates violent crimes from nonviolent or petty offenses because of the potential harm and long-lasting repercussions. As opposed to petty or nonviolent crimes, violent crimes necessarily involve an element of fear, intimidation, and physical harm coming to the victim. Depending on the circumstances, the victim of a violent crime might have the course of their lives changed forever. As opposed to someone who once committed a minor, perhaps even comical offense in their youth, those who commit violent crimes are often shunned by society. They struggle to find and maintain employment, are often barred from holding certain professional licenses, and may have restrictions placed on when and how they may see their children.

What is a Violent Crime in Colorado Springs?

Under Colorado Law, someone convicted of a violent crime is said to be guilty of “a crime of violence.” Crimes of violence are classified under Colorado Revised Statutes Title 18. Criminal Code § 18-1.3-406. Under Colorado Law, someone convicted of a crime of violence is subject to certain mandatory sentencing guidelines.

What are the Penalties for Violent Crimes in Colorado?

In an effort to prevent sympathetic judges from passing lighter sentences on violent crimes, Colorado has imposed mandatory minimum sentencing for anyone convicted of a “crime of violence.” Per Colorado law, someone convicted of a violent crime must receive a mandatory sentence “at least the midpoint of the presumptive range, up to twice the maximum authorized sentence.” Say, for example, someone were convicted of a crime punishable by between one and ten years in prison. The midpoint of the presumptive range would be about five years, meaning the person would have to serve a mandatory five-year sentence.

Generally speaking, the “worse” a crime is considered, the more severe the sentence, and the greater the minimum sentence a person would be required to serve. The most serious violent crimes carry potential sentences of up to 48 years in prison. This means that a single prison sentence can potentially mean the end of your life as you know it. Even lesser violent crimes carry potential sentences of four to eight years in prison.
